Terms of Service

Please read this Terms of Service ("Agreement", "Terms of Service") document carefully before using forMyHeart mobile application, available to you through Apple's App Store or Google Play, web application "https://web.formyheart.app" and website "https://formyheart.app" (referred collectively as "forMyHeart Platform" or "Service") offered by Tessera Multimedia S.A. ("Tessera", "we", "us", "our").

This Agreement sets forth the legally binding terms and conditions for each user's (as defined below) use of forMyHeart Platform.

If you do not want to be bound by this Agreement, please, do not use forMyHeart Platform.

By agreeing to these Terms of Service you are also representing that you are of the appropriate legal age to enter into such an agreement.

Use of forMyHeart Platform

This Service is designed and developed to help users ("you", "user"), with a forMyHeart account (explained in "Registration and accounts"), to keep track and manage their heart condition effectively by tracking blood pressure, meals, activities, medication, heart rate, weight, oxygen saturation etc.

Any information you provide to forMyHeart Platform should be accurate, complete and updated. You shall not use or access another user's account without such other user's express permission. You will immediately notify Tessera in writing of any unauthorized use of your account, or any other account-related security breach of which you are aware. The Service is available only to individuals who are adults, or children whose use is supervised by a parent and/or legal guardian.

Medical advice

You must not rely on the information presented or generated by this Service as an alternative to medical advice from your physician. The information and statistical data provided by this application are only to help you track your condition. Any diagnosis or treatment decision regarding your heart treatment or management must be taken after consulting your doctor.

The additional service provided, which would offer to your healthcare provider access to your data, would just be a data-sharing service. You will be solely responsible for following your healthcare provider's advice or not. You are solely responsible for any decisions or actions, which are recommended via the healthcare providers using our Service.

Registration and accounts

If you are a patient and want to track your condition, in order to use forMyHeart Platform, you would need to create an account via the mobile or web application. You would need to use your name, email address and create a password, and it will be your responsibility to ensure that the information you have provided is accurate and not misleading. Alternatively, you could easily sign up using your Facebook or Google account.

You cannot create an account using other person's credentials (name, email and password) or using words that are trademarks or the property of another party (including ours), vulgar, obscene or inappropriate. We reserve the right to suspend or terminate such an account.

If in any case, you suspect that your user credentials have been disclosed or breached, please, contact us at the information listed under the Contact Information section below.

As for the mobile application of forMyHeart, it also offers the option of a "guest account", where you do not provide any personal information (name and email). However, you should bear in mind that by using "guest account" your data is not backed up, which means that in case of a data loss (your smartphone has broken down or has been stolen), we will not be able to restore it. Furthermore, we cannot contact you and offer you our services as we wish, inform you about updates etc.

Modifications to the Service

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

In the future the application may be split into two versions, a Basic (Free) and a Premium version. In this case, some of the existing features of the current Basic (Free) application may be transferred to the Premium, which will be a paid version.

We reserve the right at any time to activate advertisements.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Proprietary rights

You do hereby acknowledge and agree that forMyHeart Platform and any essential software that may be used in connection with our Service shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws.

Any information presented by and through our Service is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiaristic works which are based on this Service in whole or part.

Disclaimer of warranties, limitation of liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

We do not guarantee that synchronization of data between mobile and web application will be provided continuously and without problems.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, either expressed or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Tessera, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to this page. It is your responsibility to check it periodically for changes. Your continued use of or access to the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
